These Terms of Service (“Terms”) apply to your use of thinkquestkids.com and the ThinkQuest Kids learning service, wherever you access the service from.

ThinkQuest Kids is an Australian educational service based in Victoria, Australia.

By creating a parent account or using ThinkQuest Kids, you agree to these Terms.

ThinkQuest Kids is designed for children aged 7–12, but parent accounts must be created and managed by an adult parent or guardian.

Parents and guardians are responsible for:

• managing their account;
• keeping login details secure;
• keeping the Parent PIN secure;
• supervising their child's use of ThinkQuest Kids; and
• ensuring information provided through their account is appropriate.

Children should not be given access to parent-only account controls.

Parents and guardians may create child profiles for use with ThinkQuest Kids.

We encourage the use of a nickname rather than the child's real name.

Please do not provide unnecessary personal information about a child, including their full name, exact date of birth, personal contact details, school, photograph or precise location.

Information relating to child profiles is handled as described in our Privacy Policy and Children's Privacy Notice.

ThinkQuest Kids provides educational activities designed to practise skills such as:

• logic;
• sequencing;
• pattern recognition;
• debugging;
• problem solving;
• algorithmic thinking; and
• related thinking skills.

ThinkQuest Kids is an educational resource and does not guarantee a particular academic result.

It is not a substitute for professional educational, psychological, medical or other specialist assessment or advice.

Stars, badges, missions, unlocks, avatars and similar features are part of the ThinkQuest Kids learning experience.

They have no cash value and cannot be exchanged for money.

You may use ThinkQuest Kids for lawful personal and family educational purposes.

You must not:

• attempt to access another person's account or child profile;
• attempt to bypass authentication or security controls;
• interfere with the website or service;
• introduce malware or harmful code;
• scrape or automatically extract substantial parts of ThinkQuest Kids without permission;
• impersonate another person;
• use ThinkQuest Kids for unlawful purposes; or
• use the service in a way that infringes another person's rights.

ThinkQuest Kids and its original content, including its software, learning activities, missions, puzzles, stories, characters, graphics, artwork, audio, branding and designs, are owned by or licensed to ThinkQuest Kids.

Your use of the service gives you a limited, personal, non-exclusive and non-transferable right to use ThinkQuest Kids for its intended educational purpose.

You may not sell, reproduce, distribute or commercially exploit ThinkQuest Kids content without permission, except where permitted by applicable law.

Where you provide information such as quiz responses, account information or support communications, you allow us to process that information as reasonably necessary to provide, operate, secure, support and improve ThinkQuest Kids in accordance with our Privacy Policy.

These Terms do not give ThinkQuest Kids ownership of your personal information.

ThinkQuest Kids may offer paid plans, subscriptions or other paid access.

Before a purchase, we will display the applicable:

• price;
• billing period;
• renewal terms;
• cancellation conditions; and
• other material payment information

Payment processing may be provided by a third-party payment provider.

Prices, taxes and available payment methods may vary depending on your country.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot legally be excluded.

If you are in Australia, this includes rights under the Australian Consumer Law.

If you live outside Australia, you may also have mandatory consumer protections under the laws that apply in your country or region.

These Terms do not override those mandatory protections.

Parents may delete individual child profiles through the Parent Dashboard.

Information may be retained where reasonably necessary for security, legal or record-keeping requirements, as described in our Privacy Policy.

We aim to provide a reliable service, but ThinkQuest Kids may occasionally be unavailable because of:

• maintenance;
• software updates;
• technical problems;
• third-party service interruptions; or
• circumstances outside our reasonable control.

We do not guarantee that ThinkQuest Kids will always operate without interruption or error.

We may update, improve, replace or discontinue parts of ThinkQuest Kids over time.

Where a material change significantly affects a paid service, we will provide reasonable notice where practicable and comply with applicable consumer laws.

ThinkQuest Kids uses third-party technology services to help provide functions such as hosting, authentication, data storage and email delivery.

The website may also contain links to websites that we do not operate.

We are not responsible for the content or independent privacy practices of third-party websites outside our control.

We may suspend or restrict access where reasonably necessary because of:

• a serious or repeated breach of these Terms;
• suspected fraud or unlawful activity;
• a significant security risk;
• misuse that threatens ThinkQuest Kids or another user;
• legal or regulatory requirements; or
• an urgent technical or safety issue.

Where reasonably practicable, we will provide notice before taking action.

ThinkQuest Kids is provided for educational purposes.

To the extent permitted by applicable law, we do not guarantee that every feature will always be available or that the service will be completely free from technical errors.

Nothing in these Terms excludes or limits liability, consumer guarantees or statutory rights where doing so would be unlawful.

• Children's Privacy Notice.

Parents and guardians should review these documents before creating a child profile.

ThinkQuest Kids may be accessed by families in different countries.

You are responsible for using ThinkQuest Kids in accordance with laws that apply to you.

Additional consumer, privacy or children's protections may apply depending on where you live.

Where those protections cannot legally be excluded, they continue to apply regardless of anything in these Terms.

We may update these Terms where reasonably necessary because of changes to ThinkQuest Kids, applicable laws, security requirements or our business operations.

The current version will be published on this page with an updated date.

Where a change is material, we will provide reasonable notice where practicable.

These Terms are governed by the laws of Victoria, Australia and applicable Australian law.

However, this choice of law does not deprive you of any mandatory consumer protections that apply to you under the laws of your country or region and that cannot legally be excluded.

Nothing in these Terms prevents you from exercising rights or remedies available to you under applicable consumer law.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
